Vaccine Mandate Protest Letter

No authorship claim or copyright asserted...this letter just came to me in a bottle, and I have no idea who might have penned it, nor can I possibly vouch for it, and what you fine folks do with it is entirely in your own hands, as the Gentlemen of the Bar remind me I can proffer no general legal advice in the matter, and must officially disclaim proffering any such advice here...edit and excise as you see fit, amend and append as you desire, and claim authorship or anonymity as may best befit you...as always, as you wish...

Dear Boss,

Compelling any employee to take any current Covid-19 vaccine violates federal and state law, and subjects the employer to substantial liability risk, including liability for any injury the employee may suffer from the vaccine. Many employers have reconsidered issuing such a mandate after more fruitful review with legal counsel, insurance providers, and public opinion advisors of the desires of employees and the consuming public. Even the Kaiser Foundation warned of the legal risk in this respect. (https://www.kff.org/coronavirus-covid-19/issue-brief/key-questions-about-covid-19-vaccine-mandates/)

Three key concerns: first, while the vaccine remains unapproved by the FDA and authorized only for emergency use, federal law forbids mandating it, in accordance with the Nuremberg Code of 1947; second, the Americans with Disabilities Act proscribes, punishes and penalizes employers who invasively inquire into their employees' medical status and then treat those employees differently based on their medical status, as the many AIDS related cases of decades ago fully attest; and third, international law, Constitutional law, specific statutes and the common law of torts all forbid conditioning access to employment upon coerced, invasive medical examinations and treatment, unless the employer can fully provide objective, scientifically validated evidence of the threat from the employee and how no practicable alternative could possible suffice to mitigate such supposed public health threat and still perform the necessary essentials of employment.

At the outset, consider the "problem" being "solved" by vaccination mandates. The previously infected are better protected than the vaccinated, so why aren't they exempted? Equally, the symptomatic can be self-isolated. Hence, requiring vaccinations only addresses one risk: dangerous or deadly transmission, by the asymptomatic or pre-symptomatic employee, in the employment setting. Yet even government official Mr. Fauci admits, as scientific studies affirm, asymptomatic transmission is exceedingly and "very rare." Indeed, initial data suggests the vaccinated are just as, or even much more, likely to transmit the virus as the asymptomatic or pre-symptomatic. Hence, the vaccine solves nothing. This evidentiary limitation on any employer's decision making, aside from the legal and insurance risks of forcing vaccinations as a term of employment without any accommodation or even exception for the previously infected (and thus better protected), is the reason most employers wisely refuse to mandate the vaccine. This doesn't even address the arbitrary self-limitation of the pool of talent for the employer: why reduce your own talent pool, when many who refuse invasive inquiries or risky treatment may be amongst your most effective, efficient and profitable employees?

First, federal law prohibits any mandate of the Covid-19 vaccines as unlicensed, emergency-use-authorization-only vaccines. Subsection bbb-3(e)(1)(A)(ii)(III) of section 360 of Title 21 of the United States Code, otherwise known as the Emergency Use Authorization section of the Federal Food, Drug, and Cosmetic Act, demands that everyone give employees the "option to accept or refuse administration" of the Covid-19 vaccine. (https://www.law.cornell.edu/uscode/text/21/360bbb-3 ) This right to refuse emergency, experimental vaccines, such as the Covid-19 vaccine, implements the internationally agreed legal requirement of Informed Consent established in the Nuremberg Code of 1947. As the Nuremberg Code established, every person must "be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, overreaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision" for any medical experimental drug, as the Covid-19 vaccine currently is. The Nuremberg Code prohibited even the military from requiring such experimental vaccines. (Doe #1 v. Rumsfeld, 297 F.Supp.2d 119 (D.D.C. 2003).

Second, demanding employees divulge their personal medical information invades their protected right to privacy, and discriminates against them based on their perceived medical status, in contravention of the Americans with Disabilities Act. (42 USC §12112(a).) Indeed, the ADA prohibits employers from invasive inquiries about their medical status, and that includes questions about diseases and treatments for those diseases, such as vaccines. As the EEOC makes clear, an employer can only ask medical information if the employer can prove the medical information is both job-related and necessary for the business. An employer that treats an individual employee differently based on that employer’s belief the employee’s medical condition impairs the employee is discriminating against that employee based on perceived medical status disability, in contravention of the ADA. The employer must have proof that the employer cannot keep the employee, even with reasonable accommodations, before any adverse action can be taken against the employee. If the employer asserts the employee’s medical status (such as being unvaccinated against a particular disease) precludes employment, then the employer must prove that the employee poses a “safety hazard” that cannot be reduced with a reasonable accommodation. The employer must prove, with objective, scientifically validated evidence, that the employee poses a materially enhanced risk of serious harm that no reasonable accommodation could mitigate. This requires the employee's medical status cause a substantial risk of serious harm, a risk that cannot be reduced by any another means. This is a high, and difficult burden, for employers to meet. Just look at the all prior cases concerning HIV and AIDS, when employers discriminated against employees based on their perceived dangerousness, and ended up paying millions in legal fees, damages and fines.

Third, conditioning continued employment upon participating in a medical experiment and demanding disclosure of private, personal medical information, may also create employer liability under other federal and state laws, including HIPAA, FMLA, and applicable state tort law principles, including torts prohibiting and proscribing invasions of privacy and battery. Indeed, any employer mandating a vaccine is liable to their employee for any adverse event suffered by that employee. Finally, forced vaccines constitute a form of battery, and the Supreme Court long made clear "no right is more sacred than the right of every individual to the control of their own person, free from all restraint or interference of others." (https://www.law.cornell.edu/supremecourt/text/141/250)

Don't give up on hope. USA becomes Number one economy again. The US did very well as an economy under Eisenhower until Congress fell to the Democrats in the mid terms of Eisenhower's second term. The US suffered as Democrats held Congress until Clinton's first mid term in 1994. The world prospers when USA is rich, and not beholden to scams like AGW, but focused on economic expansion.

Meanwhile, the Iran currency, Rial, falls as Trump calls out Iran on supporting terror around the world. How will the Euro go in Ireland when the alleged idiot, President Trump turns his attention to them over their support for BDS (Boycott, divestment and sanctions against Israel)? PLO were once (still are) connected to IRA. They swap weapons and expertise. They serve the same God. They claim Israel is an apartheid state but cannot support the allegation, as Israel is not an apartheid state, but a modern, functioning Democracy, and a Jewish State. Ireland is being irresponsible in supporting terror, but it is a longstanding arrangement for Sinn Fein. Imran Khan is now Prime Minister in Pakistan. His promises are not concrete. I've heard his rants against USA. What will he do?

Trump supporters are allowed to sue incompetent police in one US state where police allegedly allowed crimes against GOP supporters. Maybe, some day, victims of anti semitism can take people to the world court for crimes against humanity. Ireland would be on the wrong side. And what side would Victoria and NSW be on after their appalling treatment of Laura Southern? In Victoria, Southern was charged by police for services rendered when activists attacked an event. Only the Keystone cops failed to notice it had not been her event. Later, in NSW, NSW senior cops warned Southern from walking freely. They feared for her safety, they said.

ALP win by elections, one with 22% of primary vote. Illustrating Shorten is not popular either. Incompetents rule. Hundred year old orange trees die in drought. However, flood and drought mitigating dams are not being built by ALP or Turnbull. Already eight dams should have been built in Queensland and Northern Territory, but their ALP governments are preventing it. Farmers need money, but would prefer water. The water would be available if the dams were built. One day the dams will be built. How will people of the future view those who opposed progress?

NBN (National Broadband Network) speeds are well beneath what Turnbull, or ALP, promised. ALP wanted fibre optic cables from door to door. Turnbull modified the awful plan. What Australia needs is competitive commercial interests supplying those they viably can, leaving the state to supply those commercial interests could not. Instead we have expensive and slow internet rates even where NBN is available. A Sydney speed test for $60 a month shows download/upload speeds of 8/6 MBPS, and Vietnam Saigon shows 19/25 for $13 a month. Their communist made network exceeds Australia's best.

Malcolm Turnbull is no different to former PMs Malcolm Fraser or William McMahon. He has backstabbed conservatives and promoted awful policy, claiming the left wing will support him and the party. But Turnbull has lost any support from swing voters who prefer conservatism. And no conservative will ever get support from the left. A lot of Liberals believe the lies trotted out by Turnbull and bedwetters against Tony Abbott. But they were lies. Turnbull promised many much, when he became PM, and they were lies too. Turnbull outlined an agenda when he first became PM, he has failed utterly on any agenda item. Were Turnbull a competent businessman, he would resign to let a better candidate fill the position.

Royal Australian Navy diversity? Painting nails for diversity is not a fitting activity for Australia's defence force. Australia does not need apartheid. However, people are demanding people with Aboriginal ancestry, such as myself, have a stronger parliamentary presence than those who are not. Resist apartheid. Malcolm Turnbull's Company Tax cuts are opposed. The proposed cuts are insufficient anyway. Dump Turnbull and promote someone capable of saying why we need companies to be profitable. Unions object to raids made by police against them investigating corruption. If they weren't corrupt, would they welcome the raids? If they were corrupt, would they be any different?

Gabrielle Williams was appointed Parliamentary Secretary for Carers and Volunteers, working with the Minister for Housing, Disability and Ageing and the Minister for Families and Children. Advice to Victorian motorists to drive off from accidents to avoid car jacking. Why is the advice necessary if there is no problem with gangs? Are individuals increasingly seeking to vandalise and terrorise neighbourhoods as a hobby? Or, is it organised in a way police are not controlling? Why in Victoria, but not NSW? I've come from ALP endorsed crime neighbourhoods before. In the 1990's, ALP made Cabramatta the drug capital of Australia and the Vietnamese 5T gang thrived under ALP patronage, killing at will, including an ALP member, John Newman. The 5T gang was cleaned up when evangelical Christians met up with gang members in prison and convinced some gang leaders to change their life direction. In my survey of history I've never known of another gang to wind itself up. ALP are fostering gangs here with bad law aimed at teaching gang members how to avoid prosecution. Before the lawlessness in Victoria abates, as it will when Matthew Guy becomes Premier, criminals will have to discover hard time in jail.

As part of the November 24th Vic election campaign I have a petition I want to bring before the Opposition Leader Matthew Guy. I believe Matthew will be the next premier of Victoria and so I am petitioning him as I raise the issues of Employment, Crime and Education in Dandenong. I am also seeking money for my campaign. I don't have party resources, and so my campaign is on foot, and on the internet. Any money I receive that is not spent on the campaign will go to Grow 4 Life. I am asking questions like "What do you love about Dandenong?" and "If you could change something in Dandenong to make it better, what would it be?" I'm not limiting the questions to state issues. I'm happy to discuss anything, and get things done.

Some things should not happen, but they do. I met two lovely elderly ladies the other day from my church in Melbourne. I've not gone to church since just before my birthday in January this year. I prayed about it, but the timing was wrong. I'm too needy and don't fit in. I will go back when I'm on my two feet. But there is a cost in isolating myself, and I should not pretend it is something I bear alone. One lady is in her eighties and she sparkles. Her husband had passed when she was sixty, and now she has spent twenty years in mission work since. Including in Israel. And then I disgraced myself by asking something uppermost on my mind, what was her opinion on converting Israeli Jews? She told me a few things, but she didn't ask me why I was asking, and then she bailed. And clearly she was upset. 

I have sworn not to try to convert Jewish youth. I can't promise I won't, but as one pastor said of my writing, there are many who are much better who do it for a living. Jews don't evangelise as Christians do. Their faith leads them to raise their young. And they resent it that Christians approach their young at vulnerable times. And it is an existential threat to them, every bit as pressing as radical Islam. The missionary lady said things, like the end times are coming and it will be pretty terrible for those who aren't Christian. And she points to impending end times with talk of hucksters like Al Gore and Elon Musk. And that leads to a credibility gap. I'm not disputing the bible, only an interpretation of it which leads some to harmful behaviours. Jesus will return, and before everything will be put right, things will be very bad. And we don't know when it will happen, He will come unexpectedly, as thieves come unexpectedly. Which kind of underscores my point that end times are not being predicted accurately by Gore and Musk. Or the Australian Bureau of Meteorology. 

I'm not a Pastor or a theologian. I have a lay understanding of things. I try not to engage in semantic disputes, but I also seek to answer questions. I do not know the future of Jews. I know I have Jewish ancestry, my past is entwined with Jews. I feel my future will be too. And I think that a good thing. I want it so Jews can prosper everywhere, just as I wish most everyone else would too. But every year, many Israeli children do not prosper, but face terrible things. They should not face those things friendless or alone. And I feel it is wrong to betray the trust their parents have placed in those who offer to share burdens. I am for secular administration. I am nothing if I cannot stand on my feet. But I have everything I need when I finally fail completely. And I have the promise that He will make everything right, I need only hold on to Him.

Separate journalists discussing Trump have diverse thoughts as to who he is. One journalist has conflated Trump's campaign with Brexit and Putin and decided Trump might end the cold war Obama initiated. But, they feel that that means there will have to be nuclear war because that is what it means if a Democrat is not President. It happens all the time. Another journalist has said that Trump's first lawyer, Roy Cohn, who had been highly influential with Joseph McCarthy and Richard Nixon, was the reason why Trump has the style he has of aggressive bluster. Cohn helped convict the Rosenbergs too. So now Trump is portrayed as the heir of Nixon. Cohn had been correct about socialites who were communist agitators, and the Rosenbergs who were spies. One would prefer a Cohn advocate to an Alinsky one which Hillary resembles. According to another journalist, it is all academic anyway, as Obama is said to have destroyed Trump at the DNC. What is the bet none of the polls will reflect the effort of Obama? 

In other news, Pokemon Go is very bad because it can distract you like any other game app. The writer accuses Pokemon Go of killing a user who stumbled onto thieves in Central America. And Pokemon Go has been asked by some authorities to be respectful regarding monuments. Apparently people are concerned children will notice monuments now, and may wonder what they mean. Maybe, as with Trump, it is the journalists who are giving us their unjustified opinion. Maybe that is it?

Has the family court bomber been caught? The individual or persons responsible for shooting deaths of two, the bombing deaths of four and numerous injuries from bombs over thirty years ago, in Sydney, may at last face justice. DNA evidence at the bombing scene of a Jehova's Witness Church has been obtained. A man has been arrested on 29th July 2015, and he is believed to have been an original person of interest. It is important for a family court to be fair and just. But it is an impossible thing to satisfy everyone all the time. But even if a court has gotten it wrong, bombs are not the answer. 

Being just involves getting the hard questions right. Something that hasn't happened with Adam Goodes and the booing campaign. Former Australian of the year Goodes was too quick to hit the racism button from his first day, where he highlighted divisions of race within Australia. Race is a poor leader. Race should never be used in government to address peoples because it is intrinsically unfair. There is an industry based on race reading a myth that is hurtful and dangerous to Australia. A shameful truth in Australia is the living conditions of Aboriginal Peoples. Many of the scores for them is imported, like drugs, disease and alcoholism. But the 'cure' addressing such poverty is denied on racist terms. Aboriginals, we are told, don't go to school, don't work and don't follow the law. Racists are claiming that what Aboriginals need are separate laws, separate governments and different courts. It is apartheid and outrageous. And worse, while it is the poverty in the top end that is the issue, sponges in the big cities are absorbing aid intended for those in need.  The issue is old. But people in the past, who have greatly helped many have been denounced by the industry as they don't fit the model of what the industry wants. So instead of churches providing accommodation, family, education and health, we have welfare groups whose job is to deny these things under the visage of race collectivism. Goodes has opened this pandora's box. Goodes is a gifted athlete. He has Aboriginal ancestry. But he doesn't speak well for Aboriginal peoples. But now a race commissioner involves himself with dividing peoples on the issues. Race is not a cultural asset. Tim Soutphommasane has said an ordinary sporting chant (Aussie, aussie, aussie, oy, oy, oy") is not good because it is too aggressively nationalistic. However, Tim claims that a war dance is appropriate, even when directed at an audience. Racism is protected by hypocrisy. 

Another Union leader arrested over corruption. Shorten had claimed the royal commission was a partisan attack on the ALP. And yet important issues have been outed and are being dealt with which would never have happened while corruption was protected from investigation. 

Attack on Bronwyn Bishop amplified after failed campaign against Credlin. It doesn't matter if the attackers come from the LNP, ALP or media. Bishop has not done anything deserving of being sacked. She is a competent speaker. It would be wrong to dismiss her. But that may well happen. 

Plane debris found, may be MH370. It is a thousand miles away from the search area. But that is to be expected after over 500 days. 
From 2014
A tale of two battles with the White House being against humanity in each. In Gaza, Obama criticises Israeli people for fighting for their lives. In Ukraine, Obama criticises Putin for not ordering Ukrainian separatists to stop fighting for their lives. In each case Obama does not appear competent or realistic, but he is consistent. Ukraine are perpetuating a battle and using artillery to possibly cover up their involvement in shooting down a civilian aircraft. In perpetuating the conflict with international police in the danger zone, a case could be made for war crimes charges being brought to bear on Ukrainian military and government. In keeping with Obama policy in Gaza, if he wants peace in Ukraine, he should release everyone convicted of a sex crime currently incarcerated in the US. It won't work, but it is in line with what he has ordered Israel to do. 

Today it is the deaths of two martyrs in 1540 which highlights world policy today. Robert Barnes and Thomas Abell were on opposite sides of the religious divide. But they were both executed by Henry VIII keen to be even handed so as to not let his enemies unite. Barnes was a reformer, some might call him a Protestant. He had met Martin Luther and, after having delivered what is now called the first sermon of the English reformation, and having written treatise on religious thought, he was recognised by Wolsey and became an adviser. His advise for Henry to marry Anne of Cleves did not work out well for him. Barnes had made political enemies and after Cleves marriage went south, no one could defend him. And so he was executed. Abell was a committed catholic who applied his faith to support Henry VIII first marriage. He had printed his thoughts in a foreign country under a fake name, but his actions were considered treason, and so he was hung, drawn and quartered. Henry's decision was not based on religion, but was political. But both men had made a stance on faith, and died for it. Today, we see what happens when the foolish take sides and are not even handed. Obama might be sincere in his support for Hamas, and an unrepresentative and murderous Ukraine. But political perceptions change. 

Also on this day, in 1419, Prague experienced a series of defenestrations of her local councillors. A young woman once asked me if I wished to be defenestrated by her. I had to admit I didn't know. Turns out it means being pushed out of a window. In 1502, Columbus' fourth voyage placed him on an island off Honduras. In 1608 Samuel De Champlain shot and killed two Indian chiefs setting back French relations for a hundred years. In 1619, in Jamestown, the first representative assembly was held in Americas. In 1676, the delightfully named Nathanial Bacon made a declaration that the assembly was not being representative. Later that year he died from dysentery. If only they had listened. In 1733, the first Masonic Grand Lodge opened in the US. In 1866 in New Orleans, the Democrats assaulted an integrated GOP meeting, killing 40 and injuring 150. In 1930, in Montevideo, Uruguay won the first world cup. In 1932, Walt Disney did the first animation in Technicolor. In 1956, Eisenhower approved the monetary motto "In God We Trust" which today still confuses Democrats. In 1971, Apollo 15 use the first moon rover. In 1975. Jimmy Hoffa disappeared for good.

This declaration involves the doctrine of election: there are some whom the Father gave to Christ. It involves the doctrine of effectual calling: these who are given must and shall come; however stoutly they may set themselves against it, yet they shall be brought out of darkness into God's marvellous light. It teaches us the indispensable necessity of faith; for even those who are given to Christ are not saved except they come to Jesus. Even they must come, for there is no other way to heaven but by the door, Christ Jesus. All that the Father gives to our Redeemer must come to him, therefore none can come to heaven except they come to Christ.
Oh! the power and majesty which rest in the words "shall come." He does not say they have power to come, nor they may come if they will, but they "shall come." I am a decent man and don't care for the abuse given me. I created a video raising awareness of anti police feeling among western communities. I chose the senseless killing of Nicola Cotton, a Louisiana policewoman who joined post Katrina, to highlight the issue. I did this in order to get an income after having been illegally blacklisted from work in NSW for being a whistleblower. I have not done anything wrong.
